Terms and Conditions of Sale

Preamble

These Terms and Conditions of Sale govern the contractual relationships between Ô Retour du Marché, operated by BRONNER FANNY (Sole proprietor), SIRET 531 280 162 00029, headquartered at 19 Quai Saint Vincent, 69001 Lyon, and any person making a cooking class reservation via the website www.oretourdumarche.fr.

Article 1 – Purpose

These Terms and Conditions define the online sales conditions for cooking classes (culinary workshops) offered by Ô Retour du Marché.

Article 2 – Prices

Cooking class prices are indicated in euros including all taxes. VAT not applicable pursuant to Article 293 B of the French General Tax Code (micro-enterprise).

The applicable price is the one indicated on the website at the time of booking confirmation.

Article 3 – Booking and payment

A cooking class booking is effective after full payment by credit card at the time of order. A booking confirmation is sent by email to the customer.

Article 4 – Cancellation and rescheduling by the customer

Cancellation more than 7 days before the class: full refund of the amount paid.

Cancellation less than 7 days before the class: no refund will be made, except in duly justified cases of force majeure.

Rescheduling: rescheduling is possible if the request is made at least 7 days before the class date, subject to availability.

This 7-day notice period is justified by the need to order perishable raw materials necessary for the workshops, particularly raw milk.

Article 5 – Cancellation by the organizer

In case of force majeure or insufficient number of participants, Ô Retour du Marché reserves the right to cancel a class. In this case, the customer will be offered a full refund or rescheduling to another date of their choice.

Article 6 – Workshop proceedings

Depending on the workshop, participants take home their creations or taste them on site.

Participants agree to follow the hygiene and safety instructions communicated at the beginning of the class.

Any food allergy or intolerance must be reported at the time of booking.

The chef reserves the right to adapt recipes according to the season and product availability.

Article 7 – Liability

Ô Retour du Marché makes every effort to ensure the safety of participants during workshops. However, the organizer's liability cannot be engaged in case of damage resulting from non-compliance with safety instructions by the participant.

Article 8 – Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to leisure service provisions to be provided on a specific date. Cooking class reservations therefore do not benefit from the right of withdrawal.

Article 9 – Personal data

Information regarding the collection and processing of personal data is detailed in our legal notice, section 'Personal Data Protection'.

Article 10 – Applicable law and disputes

These Terms and Conditions are subject to French law. In case of dispute, an amicable solution will be sought before any legal action.

In accordance with the provisions of the Consumer Code, the customer may freely resort to a consumer mediator for the amicable resolution of the dispute.

Failing amicable resolution, the courts of Lyon shall have sole jurisdiction.
